This Addendum is an extension of the Boreal Sauna Company Ltd. Release Agreement. All terms regarding Release of Liability, Waiver of Claims, and Indemnity apply to the towing and transportation of the sauna trailer.

ASSUMPTION OF RISKS (TOWING)

I acknowledge that towing a sauna trailer involves specific risks, including but not limited to:

• Equipment Failure: Malfunction of the hitch, safety chains, trailer lights, tires, or braking systems.

• Operational Hazards: Trailer sway, increased braking distances, wider turning radiuses, and risks associated with reversing or parking the unit.

• Environmental Factors: Hazards related to road conditions, high winds, and inclement weather that can affect trailer stability.

• Property Damage: Damage to the towing vehicle, the sauna trailer, or third-party property.

PARTICIPANT REPRESENTATIONS & WARRANTIES

By electing to self-tow, I represent and warrant that:

• Vehicle Capacity: The towing vehicle has a manufacturer-rated towing capacity sufficient for the weight of the sauna trailer.

• Hitch Requirements: The vehicle is equipped with the appropriate hitch receiver, ball size, and electrical connection as specified by the Releasees.

• Driver Competence: I possess a valid driver’s license and have the necessary skill and experience to safely operate a vehicle while towing.

• Inspection: I have inspected the connection (hitch, chains, and lights) before departure and will continue to do so during the rental period. I have also inspected the sauna before departing and have documented any concerns relating to damage or condition with Boreal Sauna Company.

• Damage: I am responsible for returning the sauna trailer in the same condition I received it in. Any damage or cleaning charges will be taken from my deposit or charged to the credit card I provided.

INDEMNITY AND WAIVER

• Waiver of Claims: I waive any and all claims against the Releasees for any damage to my personal towing vehicle or loss arising from the towing process.

• Indemnification: I agree to indemnify and hold harmless the Releasees from any third-party claims, legal fees, or damages resulting from my operation of the towing vehicle and trailer.

• Governing Law: This addendum is governed by the laws of Saskatchewan.

BY SIGNING, I CONFIRM THAT I HAVE READ AND UNDERSTAND THIS ADDENDUM. I AM AWARE THAT BY SIGNING THIS DOCUMENT I AM WAIVING CERTAIN LEGAL RIGHTS.
