RENTAL TERMS AND CONDITIONS OF USE — BOREAL BIRDIES DIVISION
This Rental Agreement must be signed by the principal “Renter” i.e. individual who holds reservation or booking and/or pays the majority of the rental fee. The Renter must be 18+ years old.
TO: Boreal Sauna Company Ltd. (operating as Boreal Rentals and Boreal Birdies), and its directors, officers, employees, contractors, agents, volunteers, representatives and assigns (collectively, “Boreal Rentals”).
IN CONSIDERATION of Boreal Rentals agreeing to rent to me a mobile golf simulator trailer and associated electronic tracking equipment (referred to as the “simulator”) on the terms and conditions outlined in this Rental Agreement, and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, I, the undersigned Renter, understand and agree that:
RENTER’S ACKNOWLEDGMENT AND AGREEMENT
A) I am aware of the risks of golf simulator use (including swinging clubs and high-velocity balls) and that I have read, understood and signed Boreal Rentals’ “RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT” (the “Waiver”);
B) I AM RESPONSIBLE FOR ALL GUESTS including those not accounted for by Boreal Rentals at time of booking, and I assume all risks associated with any and all guests using the simulator and/or being present at the rental location during the rental period;
C) I have RECEIVED OR PLAN TO GET COPIES OF THE WAIVER FOR ADDITIONAL UNACCOUNTED GUESTS to read, understand and e-sign prior to using the simulator;
D) I will ensure that ANY MINOR (any person under the age of 18) WILL BE ACCOMPANIED BY A PARENT, LEGAL GUARDIAN OR RESPONSIBLE ADULT, and that both of the aforementioned have read, understood and signed the appropriate section of the Waiver and acknowledge that copies of that document have also been left in my care via the borealsaunas.ca website, should any unaccounted minors wish to participate;
E) I will ensure that any guests with health or mobility conditions that require assistance of another person WILL ALWAYS BE ACCOMPANIED BY ANOTHER ADULT;
F) the CANCELLATION POLICY below shall apply in all circumstances;
G) I will be AT THE RENTAL LOCATION AT ALL TIMES WHEN THE SIMULATOR IS IN USE during the rental period; if not, I WILL BE HIRING BOREAL RENTALS STAFF TO SUPERVISE THE ENCLOSURE.
H) I will INDEMNIFY BOREAL RENTALS from any loss, damage, liabilities, costs and expenses suffered by Boreal Rentals, directly or indirectly, as a result of or arising out of this Rental Agreement and/or my breach of any term of this Rental Agreement, including my failure to obtain a signed Waiver from all guests using the simulator; and
I) I have READ AND WILL COMPLY, and will ensure that ALL GUESTS READ AND COMPLY, with the terms and conditions below and all other equipment safety notices provided with or inside the simulator trailer, at all times during the rental period:
A. SAFETY
The Renter, at all times, must be prepared to offer assistance or call for help in the event of an injury.
B. HEALTH/SAFETY RECOMMENDATIONS
Due to the risk of serious injury from high-velocity golf balls and swinging metal clubs, it is highly recommended to limit or monitor the use of alcohol or drugs during the use of the simulator.
To prevent physical fatigue or muscle strain, it is recommended that players pace their session intervals, trade off active play frequently, and maintain adequate hydration.
Children must be monitored closely by an adult at all times inside and around the trailer to ensure they do not step into an active swinging or hitting zone.
C. PROHIBITED SUBSTANCES/ACTIVITIES AT ALL TIMES
No person may use the simulator if they are ill or feeling ill.
No smoking, vaping, or open flames are permitted inside the simulator trailer at any time.
No food, liquids, or open beverages are permitted near the electronics bay, launch monitor, projector, or hitting mat enclosure.
No sharp objects, breakables (glass or ceramics), or tracking-disruptive materials are allowed inside the simulator bay.
Do not climb on the exterior structure, the roof, or structural enclosure frames.
Absolutely no multi-person swinging. Only one active player is permitted inside the hitting bay safety enclosure at any time. All other guests must remain a safe distance behind.
D. POWER AND ELECTRONIC OPERATIONS
The simulator requires a dedicated electrical connection. The Renter agrees to only use the heavy-duty power extensions and surge protectors provided by Boreal Rentals.
The Renter must not tamper with, unplug, or attempt to modify any internal wiring, components of the tracking launch monitor, projector calibration, or computer systems.
In the event of a system crash, software error, or power disruption, the Renter must immediately contact Boreal Rentals for troubleshooting rather than attempting self-repair.
E. OPERATION/EQUIPMENT MANAGEMENT
Maximum Occupancy: There is a maximum capacity of one person at a time in the golfing area.
Screen & Ball Protection: Only the specialized, clean, unmarked golf balls provided by Boreal Birdies may be hit into the impact screen. Do NOT use marked, dirty, or sharp-scuffed golf balls, as markers/dirt permanently ruin the impact screen material. Part of the damage deposit will be kept as a cleaning fee if this occurs.
Club Safety: All club faces must be clean and free of dirt/mud before hitting to protect the screen and mats. Ensure structural clearances are checked before executing a full swing.
Electronics Liability: Do not place personal items, phones, or extraneous gear on or near the launch monitor unit on the floor. Boreal Rentals is not liable for accidental damage to personal clubs, phones, or property brought into the unit.
F. DROP-OFF/PICK UP
Boreal Rentals will work with the Renter to find a mutually agreeable time for set up up and pick up.
The Renter will ensure that they have an authorized, flat, safe, easily accessible location on private property, or approval to set up on public property. The unit requires a clear footprint of 20' deep, 15' wide, 11' tall. If Boreal Rentals arrives to find an unsuitable, un-level, or unauthorized location (a) this will be treated as a cancellation with less than 24 hours notice (see Cancellation Policy below), (b) the simulator will not be dropped off and (c) the Renter will not be provided with a refund.
The Renter will ensure that the simulator is not moved after Boreal Rentals completes the leveling and setup sequence.
The Renter will ensure all provided clubs and accessories are neatly stored in their designated compartments prior to the scheduled pick-up time.
G. EQUIPMENT AGREEMENT/PAYMENT/DEPOSIT/CLEANING
The Renter will pay a $500 damage deposit (the “Damage Deposit”) at the time of drop off. The Damage Deposit is in addition to the rental fees.
The Renter agrees to pay the rental fees as follows: (a) 50% at the time of booking; and (b) 50% anytime before the time of drop-off, unless a different arrangement is otherwise agreed to by both parties.
Boreal Rentals and the Renter will examine all electronic tracking hardware, computer bays, screens, enclosures, and trailer components at the time of drop-off and note any existing deficiencies. The Renter is fully responsible for any and all loss or damage to the high-end simulator tech, projector, tracking systems, or structural equipment while at the rental location.
In the event of any equipment damage, screen tears, component loss, or return of the simulator in an excessively unclean state, Boreal Rentals will apply the Damage Deposit towards the cost of specialized repairs, replacement parts, tech support, and/or cleaning fees, and return the balance of the Damage Deposit, if any. In the event the cost of specialized technical repair or replacement exceeds the Damage Deposit, the Renter agrees to pay the balance to Boreal Rentals within seven (7) days of notice of the amount owing.
Boreal Rentals will ensure that the interior and golf gear are cleaned and sanitized before and after the rental period.
H. CANCELLATION POLICY
Boreal Rentals understands that plans change for many reasons including those out of our control. Therefore, Boreal Rentals offers, and the Renter agrees to the following cancellation policy:
Cancellations more than 48 hours prior to the start of the rental period shall receive a full refund of the rental fee.
Cancellations between 24-48 hours prior to the start of the rental period shall receive a 50% refund of the total rental fee.
Cancellations within 24 hours before the start of the rental period are not entitled to a refund of the rental fee, and any outstanding rental fees will be due and owing to Boreal Rentals (however, the Renter will not be charged the Damage Deposit).
In the event of unsafe weather, the booking will not face any cancellation penalties. Unsafe weather would be rain, high winds, or lighting in the area. Cold/warm temperatures are not classified as unsafe.
I. PRICING & LOGISTICS
Boreal Rentals has a sliding rate scale depending on peak rental usage and custom event package configurations. Current rates will be posted on our official website.
In addition to the rental fee, a delivery fee of $1.50/km will be applicable for any deliveries outside of Prince Albert.
Boreal Rentals will provide a complete set of standard golf clubs (right/left-handed as requested) and premium simulator golf balls for use during the rental period.

This Rental Agreement is governed in accordance with the laws of Saskatchewan.
I HAVE READ AND UNDERSTAND THIS RENTAL AGREEMENT AND HAVE BEEN GIVEN THE OPPORTUNITY TO OBTAIN INDEPENDENT LEGAL ADVICE WITH REGARD TO THIS AGREEMENT. I AM SIGNING THIS DOCUMENT VOLUNTARILY AND WITHOUT INDUCEMENT.
